Having been placed in these horrible circumstances?? Are you kidding?? This implies that everything that happened was someone else’s fault and Shellye had no choice in the matter. EVERYTHING that happened was Shellye’s fault. ALL of the choices were hers. From getting the gun, to lying in wait in the middle of the night for Dale to come home, to pulling the trigger on the .357 magnum all six times until Dale was DEAD. Everything she has “endured” is because she chose to.
“She was charged with murder despite the estranged husband's violating a valid restraining order obtained because of his numerous, recent, death threats against her, their son, as well as against her friend and his child.”
Real cute way to twist the facts. How could Dale be violating a restraining order he had just barely been served with? Even the police allow you to gather some things and don’t just expect you to leave on the spot.
“Mr. Stark, having been served with the restraining order was angry enough that he did not comply with the court order. Instead of leaving the home he turned and went after Shellye...”
There is not one time in any of the statements given by the nephew, the son, or even Shellye herself that at any time Dale EVER went after her that night. Shellye’s own statement is that he called her a “b*tch” (oh no) and that he was looking in the direction of the knife on the counter. It was her assumption alone that he was going to pick it up that caused her to unload the .357.
“Shellye, afraid for her life, stood up for the first time ever and defended herself.”
Anyone that really knows about domestic violence and abuse would know that the hardest thing a victim ever does is get out of the situation which would have been when Shellye moved away from the man and filed for divorce. Arranging to be there alone with the man who made her fear for her life sounds like someone trying to get a bit of revenge.
“It happened because Shellye endured twenty years of abuse, coercion and blackmail at the hands of her husband. Her own husband, the 'man' sworn to cherish and honor his wife, instead, alienated her from her family, tore apart her self-esteem and then literally forced her to work as a prostitute so he could maintain his gambling habit.”
No. It happened because Shellye chose to arm herself with a gun and sit at his house in the middle of the night with no law enforcement to serve a man, she was supposedly afraid was going to kill her, with a restraining order. But if you want to believe the statement from the website, it still makes it sound as if she was there for revenge.
The second sentence is an ironic choice of words to be written by a man who at one time swore to cherish and honor his wife but now tells people that she is dead among other things that are equally false. Additionally, if Dale was forcing her to prostitute to maintain his gambling habit, what was she maintaining once she moved away from him but still remained a prostitute? Especially if she was a licensed teacher, as the website claims, but she chose to remain a hooker which was supposedly a profession she was forced to be in and never chose. Hmmm..just one more thing that doesn’t make sense. Not surprising.
BH declaration filed with Shellye’s request for restraining order:
“10. ‘Was’ is the operative word in the matter before the court. Petitioner has worked to take charge of her life and escape the cycle of violence she endured at Respondent’s hand. Respondent’s loss of control over Petitioner has caused him to escalate his harassing and violent behavior. I am absolutely certain that this matter warrants a restraining order to protect Petitioner and her son. Moreover, I am not even confidant that a restraining order will be enough to make Respondent act in a civil manner. I am afraid that this man will simply act out his anger.”
He states he doesn’t believe a restraining order will even stop Dale from acting out his anger. If BH and NJ both believed this, what other reason could she have for getting into a situation where she would be alone with Dale in the middle of the night with just her and him and a .357 magnum revolver???
He also states in his declaration that they discussed where she was in her divorce and how it needed to be handled in addition to claiming to have a degree in psychology and therefore a clear understanding of the type of person Dale Stark was. If this is true and they discussed these issues, the only conclusion that one can come to is that Shellye obviously had no respect for BH’s views or opinions in the matter since I doubt he would say that he told her it would be fine for her to be there to serve Dale and not bother law enforcement with the matter. She must have decided that he was a complete idiot and decided to do things her way.
And no, I am NOT an attorney and don’t pretend to think that I am. But if an ordinary person like me can see all this and ask these questions, what do you think the prosecuting attorney is going to come up with since he’s the pro in these matters??? And NO I was not there, but guess what Einstein, neither was the prosecution, the defense, the jury, or the judge. So it all comes down to what makes sense and what doesn’t as well as the credibility of the people in front of the judge/jury and Shellye’s credibility is not only going to be based on her own actions and statements but also of those closest to her that she chooses to associate with and BH’s credibility is so questionable it’s not even funny.
Personally, I couldn’t care less about a BH witch hunt but this is not solely about Dale and Shellye. BH got himself involved because of statements he made in his declaration and setting up the freeshellye website and collecting donations on her behalf, among other things. All you seem interested in doing is bringing YOUR personal agenda to this board regarding Jenny and carressamor and whoever else at your TZ site that you have a problem with and the only thing you’re accomplishing with that is giving more evidence to any of the powers that be that might be looking into TZ and the people there. What an idiot you are. Doesn’t matter what you say or how clever you think you are. You don’t have the knowledge or the intelligence to hit a nerve here and all of your brainless babble will never change the facts. That’s about as point blank as the shots fired by Shellye.
